A joint motion from prosecutors and defense attorneys filed Wednesday seeks a court order to get WakeMed to release video from the day officer Roger Smith was shot and killed.
Smith, 59, was working at WakeMed Garner Healthplex was shot and killed after getting into an altercation with a Benji Martin Jr. on Nov. 8.

Martin, 29, is charged with Smith's murder.
Attorneys want a judge to order WakeMed to produce unredacted surveillance video from the emergency room area, including the waiting area, of WakeMed Garner Healthplex taken from 6 a.m. to 11 a.m. on the day of the incident.
The order also seeks WakeMed to produce any staff or witness statements concerning Smith's death that it has, including any electronic communications with law enforcement.
Martin's medical records and any records of treatment received by Smith are also included in the motion.
A status hearing on the case is scheduled for Thursday.
